does this vary by state or if so i live in virginia any experience or knowledge would be very help ful . can i go to jail ?

they payday place was done all online with my electronic signature so i did not actully write a check but i still know that i was committing myself to pay it back but i had some really bad hardships and was able to its been about 3months and today i got a threating phone call about being proacuted for check fraud i want to make payment arragments but they wont ecept want im offering what can i do ?

It depends really,

Collections, more than likely, or they could file against you in a civil manner, or they could in theory try to claim that you're passing bad checks.

Best bet is to make some sort of arrangement if you owe them if you haven't already. Best not to find out...

You shouldn't have gotten the loan and not paid on it for 3 months hardship or not. And if it was that much of a hardship you should have called them the first month and set up a payment arrangement. Ignoring your bills does not make them go away it makes them WORSE. I had to file bancruptcy after my ex-husband decided we didn't need to worry about our bills. You can give a thumbs down all you want, but you need to take responsibility. They can put the check through and they will as soon as the money is showing in your account. They can also put it through anytime they want and make you have overdraft fees. The likelihood of going to jail is pretty low, but come on you can afford to have internet, a computer and spend time looking for answers to how to get around paying your bills. Pay the bill and move on. You took it out, you owe it and the penalties. If you don't like it, don't take out the loan.

They will take whatever they can from your checking account. The collectors for payday loan companies are extremely "aggressive". They also don't bother to follow the rules.

They will threaten you with jail. They base this on the check being bad. I don't know if this actually works for them or not.

But it is very unlikely they will take you to court, as courts tend to take a dim view of usury interest rates. Payday loans are illegal in some states. I don't know about Virginia.

Well, it will ruin your credit and they will start tacking on all kinds of fees, penalties, and interest.

You should NEVER get one of these, but if you do, the LAST thing you want to do is not pay it!!!! Pay it and move on. Don't ever step foot in one of these places again!!!!
