This is ridiculous.. If I buy a Brand new car I want a spare tire.. I was amazed there was no spare in my 2015 had to call a tow 2 times and miss work total waste of time and very unsafe.. Its not about safety anymore its about money.. They take it out just to sell it back to u or dont even make u aware of this.. U find out once its too freaking late.. Im steming mad right now.. I wouldn't say no just that quick. But I would check it out with your local Department of Motor Vehicles office to make sure. As reading some of the laws in this state things are sure different. There sure is alot to go through to sell a vehicle in this state. http://www.dmv.ca.gov/vr/sell.htm
The best thing I would do is do a statement of facts which is located on that site for the DMV.

If you check with your dealer, they sell "spare tire kits" this included the jack and "donut" spare good for 100 miles at 50 MPH. You can check on-line for one, there are a lot for sale or if you are good, get a used one from an auto recycling (but be careful of the age of the tire). Many new cars do not have spares, from expensive to base models. You must be careful as there are different kits for different cars due to the jack or tire. 16 - 17" tires use the same smaller spare, 18" tires use a different spare size. The kit from the dealer may not include a tire, that would be a separate price or sometimes the dealer only sells the small width rim. You have to find a place to buy and install this "donut" tire on the rim they sell. YES, many people are shocked to find out they have no spare. The KIT that comes with the car to inject a sealer will most likely damage the tire and low pressure sensor. The goop that is injected is hard to remove to seal the tire from the inside (the correct way) and the goop can ruin the $75+ tire sensor. Without all four sensors, a dash "low pressure" light will always appear.

no new car some time don't have a spare from factory.
but do tell the person you're selling it to that there no spare for it .

No. Many cars that come with runflats stock dont even have spares. Most BMWs do not come with spares now. Many porsches dont either (they just come with a fix-a-flat kit).

no, but if this is an issue either go to a junkyard and get one or just tell buyer there is no spare and you should be ok.
