Homeland Security will probably consider this money laundering.
U.S. Customs can make you pay duty on the diamond, even if you have had it for years. You are officially supposed to declare it on a form before you leave the U.S.
In reality, Customs won't check diamonds on people's fingers. If they did, they could tax nearly every married person who enters the United States. So wear the diamond through customs.

If you buy an unset stone, you don't have to declare it in customs. But if the stone is part of a piece of jewelery ( in a necklace, ring earrings etc..) then you have to declare it.

Oh god no! Jesus jewelry is always fine. I mean how is customs going to know you didn't bring it on vacation in the first place?

It's legal but you might have to pay a tax on it.
The person who sells it to you will tell the US customs that you bought it; so don't try to sneak it in.
