Yes, the threats are illegal. Now, you ask, what's to keep him from following through on the threats? Not much. The police cannot intervene if a crime has not been committed.

HOWEVER, you can tell your attorney that he has threatened this action and ask if it would be possible to set up supervised visitation. If you can prove that he has made the threats, the judge will probably agree to his visitation taking place at a neutral place that supervises troublesome visitation (others have made these same threats, you see, and someone was listening and set up these places to keep the children safe).

Definitely do NOT let your ex see that he upsets you. There are some people who feed off this type of behavior and you really don't need it. Until he is calmer, I wouldn't even talk to him. Set up all visitation and all negotiations through your attorney. If he doesn't get the fun of seeing you get upset, he will quit this infantile behavior. Do not get upset, to not play "gotcha last." Just be calm and move on. People like this have a short attention span, thank heaven!!

Threats themselves may not be illegal. It depends on the threat and the local and state laws regarding those threats. However, threats should never be taken lightly. A threat of this nature should be reported to law enforcement and your attorney. You should go down to the police department with your children and make sure they have the kids photos and fingerprints on file and any other information they need. Then you need to discuss with the police what you should do about this. Let them advise you. Also provide a set of your kids photos, fingerprints, etc., to your attorney. You may need to put a restraining order in place or have visitation temporarily revoked for your husband. If it cannot be revoked, ask for supervised visitations only. The family courts do not take these kind of threats lightly anymore

Yes. You can get a restraining order. My gf did this on her ex. All she had to do was call the cops (not 911!)... the department. Have a cop come out and take a report. He will then give you a case number. Go to the city county building, go to the prosecutors office, fill out the paperwork, meet with the Magestry, then the judge. A Marshall will serve your bf papers to stay away. If he calls you or even tries to contact you through a friend or relative you can have him arrested. Make sure that you record telephone conversations, keep emails after so that you can prove it. It takes about 4-5 hours to get everything done, but is totally worth it. Best of Luck.

see an attorney as soon as possible. If it hasn't yet been decided who gets custody that would be a shadow area and he could argue that they are his kids also. once the matter of who gets the kids is decided - probably you if he is childish enough to threaten to kidnap them - then it can be kidnapping if he takes them. if he is bothering you in other ways - coming by the house uninvited, constantly driving by the house, bothering you at work, and a few other things, go to the police and get a restraining order to keep him away.
If you had the hearing already and you have been given custody, get the restraining order without waiting.

no making threats is not illegal
you could file a police report for the treats and say you are afraid then get a restraining order but you have to prove to the court that you and your children are in harm
no if your ex is the father then it is not kidnapping
you might want to get to court asap to set some sort of custody paper work if not it could just look like a father took his kids out
and you disagree.

Yes, it is illegal! Call the police and get the ball rolling on a restraining order. That is a serious threat and you should do everything in your power to prevent it from being carried out.

Go to court and get legal custody. They are his kids too so if he takes them before you file for custody, you lose. Because who ever has posession of them, has them. If you are divorcing him, talk to your lawyer and get that divorce going.
