Does anyone know if this is legal?? I work at a med size company in California, they fired this person but we are all friends and still hang out with him. Now the company wants to "ban" us from talking to him!! Are they crazy!

legally they bcan not do this. however, most companies still use this tactic. if i were you, i'd try to get them to give this to me in writing and sue their azz later. they will most likely try to say that they and you have agreed on a confidentiality agreement and you still conversing and corresponding with disgruntled employees is violating those terms. WRONG! they are violating you and your rights to privacy and free choice.

On work time, yes the can. When you're off work, weekends or evenings, it's none of their business whom you hang out with. An exception might be if you're a cop and the person is a criminal.

I wouldn't go out of my way to let my boss know we're still in contact though.

They cannot ban you from talking to him in your own time, but they can ban you from disclosing company deals and business plans, etc. For e.g. you can be banned from telling him what the co. planned to bid for and for how much, etc.
