I can understand that it's a difficult thing to deal with but you need to figure out why she doesn't want to be with you and work on fixing it. Most probably it's a lack of emotional contact which means your friendship, (which by the way is the most important part of your marriage) is not what it needs to be.The fact that you asked this question the way you did speaks volumes about the kind of man you are.
The answer to your question is ANY sex without mutual consent , including within a marriage is Rape !!

well, legally women are not allowed to withhold sex. Its part of the legal binding they committed to when the agreed to marry. However, men are also bound to tending to a womans needs as well. If she needs some "time off" you've gotta give it to her. I think its unhealthy to go without sex for any longer than a week in a marriage. You lose a sense of closeness and intimacy... and the husband is likely to get really pissy. It's just not a good call.
I've actually heard of this coming up in court, years of a wife not putting out led to a divorce. She was sued by her husband and he won a load of money. I dont remember the actual reasons but something about "loss of affection" and "failure to provide services ...something" Similar to someone who would say take your money for building you a porch, then not do it.

Rape is defined as sexual congress against the will or without consent. To describe lack of consent as "with holding" implies that you have some sort of right to sexual access; you have no such right. Consent, once given, can be withdrawn at any time. Any continuation after that consent is withdrawn is rape.
I suggest that you start thinking in terms of addressing and solving marital problems as husband and wife, rather than thinking unilaterally in terms of securing your own gratification by whatever means you can get away with.

My husband doesn't want me to go with sex just because he wants it but waits until I am really ready - we have sex usually once or twice a week. If your wife works full time then maybe she is too tired - ask her to let you know when she is ready or sometimes we plan ahead and stick with the plan. It is difficult with work and kids. All about the communication.

Any forced sex on another person is rape. Married or not. Tell her your needs are not being met. If she is not willing to find a way to met your needs, I'd tell her that I was going to be forced to have them met somewhere else. I wouldn't force myself on her. You can still go to jail for raping your wife.
