i dont mean for a legal separation but a separation which might be the equivalent of a divorce but without having to appear in front of a court for this.

In India for taking any legal dissolution of marriage the couple to such marriage has to move the Family court for decree of divorce, annulment or judicial separation as the case may be. There exist no such out of court settlement that can make such separation legal as decree of any of these. Any one guiding any one regarding any such, even written mutual agreement between the two without moving the family court is not valid & will not legally dissolve such marriage between these two.

You cant have a legal solution if you keep the courts out of it. The courts are always a part of any legal solution.

If both of you are willing for divorce you can get it in 6 months in divorce by mutual consent.

The only winners in divorce are the lawyers. If you and your husband can agree on this set up then I'd go for it. It might be worth making a will laying out what you would like to happen to any of your stuff. Without wishing to sound morbid, you may actually gain if your husband's pension provision includes a widow' s pension. If you are divorced, you won't get this. Divorce would mean trying to sort out a property settlement as well. The old adage about two living as cheaply as one is very true.

You can ask legal judicial separation in family court; but it should be mutual, and you have to appear at least once in the court. for more refer http://mynation.net
