the supreme court has ruled, that when out in public, you have no right of privacy,.....but if you take pictures of some one and make money off that picture, that might be another story,.....

If they hacked or circumvented MySpace's security to get that photo, you might be able to take it up with MySpace. If it was received legitimately, you may not have much say in it. By putting the photo online, you take the risk of it becoming public, but you still own the legal rights to the picture and could probably take the person to court for stealing it. Just because the web allows you to print or download something doesn't make it legal to do it. If anything, the better thing to try and go after them for would be any threats they're making, as opposed to downloading the photo.

It is not against the law but can be viewed as harassment if the person ask you not to take the picture or if the person is under 18.

It depends on the situation. If you're in public, and the person hasn't specifically asked you not to take a picture, and you aren't using it for commercial purposes, then it is legal.

It is legal to take pictures of someone else.
Assuming, of course, you're not taking pictures up someone's skirt.
Then you're breaking the law.

i think it's legal to do that...i oftern take pix of the other people..and i also take pic of myself.. that's fun haha
but if you do that furtively withou any permission...that means..you are doing something bad.. other people's private life was protected by the law..at least in china it's illegal..
