divorce senario: my friend has been seperated and in the divorce process for 2 years now. it's coming down to the wire here in a couple of weeks. his lawyer asked her to bring all of her financial papers for the past 2 years. so he just found out she quit her job so she would have $0 income when she got to court. she's trying to take him for everything and he's scared. the saddest thing is when they were married he adopted her daughter (which she had previous and the father didn't stay around). he's taken that responsibility and remained in her life and pays non-court ordered child support for her, $600 a month. i feel bad that he's been so generous and now his ex is trying to take him for everything...have you been through a divorce? if so...how likely is it that he will get "robbed"?
FYI
she left and came back several times before he changed the locks! now she is shacked up with her new bf which gives him suspicion of cheating!

the fact that she quit her job is going to work against her since she had a job for the 2 years that the divorce was pending, and the fact that he adopted the daughter and she is living with a new boyfriend should allow him to take the daughter as well. he might even take the bills for the new locks to show that he had to do that. I hope tings work out for him and she gets what she deserves.

Usually income etc is calculated on the date of separation... not when you go to court. So... at the date of separation is when income and debt is calculated. She may have misstepped here.
Your BF's lawyer will know what to do.
Shame on her for shacking up with a new BF too. What is that telling the daughter. Does he want the daughter living with him> That should scare her to death. Is daughter interested in living with him? Could save him a whack of money too.

What your friend is doing is way too common. One spouse decides to "get back" and take a job that pays less, or not have a job at all. A good attorney will show the courts her earning potential, so she is really hurting herself and the kids. Karma is biotch!

If he has a smart lawyer then she wont take him. Don't leave it all up to the judge whatever else he does, there are judges who favor moms no matter what and then there are judges that favor dads no matter what, maybe trying to even things out, who knows. The job quiting bit will show her true colors to any unbiased judge. Good luck
