My boyfriend just recently got a ticket for public urination. He was behind a dumpster with enclosed walls. All the bars were packed with people and he really needed to go, since he was drinking a certain protein shake that had an ingredient in it to clean out his system.
I thought that this was a whole set up. The bicycle cops rode and stopped at the dumpster. So I assume that they were waiting around for a victim. Anyway my boyfriend had already finished when the cops came. So the cops didn't see him during the act. My boyfriend admitted to it and was polite, thinking that he'd get let off with a warning.
Now he has court coming up and everyone is telling him to plead not guilty. How would that work if he admitted it to the cops and then plead not guilty in court. Some say after he pleads not guilty, they will have another court date. Usually will the judge throw the case out and will this be on his record when it comes to background check if he does gets fined?

If you haven't been given a lawyer yet, then this isn't a trial. It is a hearing. You go to hearings before you go to trial. At hearings you talk with the prosecutor and judge and, possibly, your own attorney. Really, there are three things that could happen:
1) You accept the fine. You can plead "guilty" or "no contest." It will go on your record and you'll pay your state's penalty.
2) You claim innocence. If the police lack the evidence, you won't be convicted. However, they only have to provide a reasonable amount of evidence because this is not a large crime (e.g. murder). In this case, a police officer saying "he did" is enough proof. However, the police officer might be busy the day of the trial. If you're convinced, this route will be the most costly in terms of fines imposed.
3) You talk to the prosecutor and seek a "continuance for dismissal." This is the legal equivalent of, "Oops! Sorry, won't happen again." He'll have to pay "attorney's fees" usually about equal to whatever fine he would get if he were convicted. The plus is that this won't go onto his record if he doesn't do it again in 3 years. The minus is that, if he does do it again he can't get a continuance for dismissal on that action AND this will go on his record, too.
I suppose there is another option, too.
4) He could skip town. There will be a warrant made out for him.

I would say there's a good chance the cop won't even show up. If he doesn't, then there's no worries. If the case gets thrown out, then it won't show up on his record. I'm not sure what would happen if he pleads not guilty but I would think this would only be a misdemeanor anyway. I would think that worst case scenario is he ends up with a fine. You should do some research on the internet to find out for sure though.

Just fight it. The cop may not even show up. When I was in college I got a ticket for peeing in public in a parking lot. The owner reported me. I had to pay the ticket. The next time I was out I just whizzed on his door way. Pretty lucky I wasn't caught that time.

it's basically a misdemenor charge and if he admitted to the cop he did it then he needs to stick with that, i wouldnt take the chance lying in court, it will probably make the situation worse than it is, its true the cop may not even show up but still just stick with the truth, tell the judge exactly his reasoning and im sure if he has never had issues with the law in the past he will either get a slap on the wrist or a small fine..good luck! s h i t if you gotta go you gotta go, i would of done the same thing.

He needs to plead guilty. Its just a stupid misdemeanor and won't reflect too badly on him if this is an isolated incident. He is obviously guilty of committing an offense that is illegal in your area, has admitted once to it, and would (I would assume) admit to it again in court. The judge has no choice but to nail him, so best to just plead guilty and use it as a learning experience.

I got caught by the bicycle cops too. I went to piss in an alley while my girl waited. Once I finished peeing I turned around and walked out of the alley buttoning my pants. The cycle cops came up on me and said that's the most expensive pee you ever took. I apologized and they let me go.
