My boss is being demoted. A position is being created for him. I am also interested in this position. Can my employer just create this position and appoint him to it, or are they legally obligated to "post" this position and allow others to apply for it?

Job postings are governed by company policy, not by law, in most cases. The company could create the job and move him into it without posting it for others to see. If they do post it, you should apply.

No employer is required to go in any particular order or offer any job to any employee.

The job creation for your boss is very common when someone in upper-management is demoted.

It's their right to organize their staff - they can just give him the newly created job, they don't have to post it.
