My husband has been paying child support for six years, $317 a month. His ex keeps threatening to take him back to court for more money, but the way she brags it seems like she and her husband make about twice as much as we do. Does anyone know if they take the spouses income into consideration in Wyoming? We haven't hired a lawyer yet, but it seems like it would be worth it just to shut her up.

hey there Steph...with having this problam myself in NY they will not change the amount the parent pays if they are remarried..unless they get a pay raise...the money he give is for the child.....and unless the child's needs go up..that is all that will be giving....my husband's ex was trying the same thing with him...and she gets just about 400.00 a month for one child....if u have any more questions I would be happy to help ya...

no they only consider the Partents Income not the step parents, because they are not required to support the childern. However if she has gotten a new job you can take her back to see if you can lower it, but however if your husband has had any sort of finacial gain, and less amount in bills, the courts will more likely raise the child support they like to do that.

No a spouses income is not a factor in determining child support. Only the biological parent.

yes if the father is remarried, both of their incomes are considered in paying child support

if you are now remarried you have two incomes instead of one. It is not your income that is supporting the children. It is yours and your husband's.

the father can take you to court to have the amount lessened.

See the lawyer. In most states it is the former spouses income that is used. You want it reduced because her new husband makes more money? The kids are not really his responsibility. It is and should be the responsibility of the parents to provide for their kids. Not who they later marry. ( legally) Morally make up your own mind.

No, the new spouses income shouldn't. At least that's how my parents have it.
