I am a Dad who went to my sons house to pick him up for my weekend visit. The step dad met me at the door asked me why I was here and pushed me, started fighting me and then commanded his dog to attack me . the police were called and sent me to the hospital with severe injuries to my legs. The police charged me with trespassing but I have done nothing wrong except go to pick up my son. Can anyone help me and do I have a case. This was in Mesquite TX and the dog was reported and pick up by animal control.

The Texas Legislature just enacted a new law concerning the liability to victims of dog bites (Lillian's Law). It became effective September 1, 2007.

Your dog has probably been extremely frighten. Both from the dog fight and when your dad had gotten close to his face. If possible, try and let Biagio hang around a dog park and let him get more comfortable around other dogs that are hopefully friendly. You should do the same thing with your dad and Biagio. If Biagio was surprised when the other dog attacked him, then he may always try to defend or attack something that surprises him, such as your dad getting close to him when he is sleeping. That would also take the father's trust away from the dog. As any person, it can be kinda shocking to have someone right next to you waking up that you weren't expecting. In the mind of a dog, it may be worse, especially after being attacked not too long ago. I hope your dog starts acting normal again soon and i hope this helps some.

If you have a court order that says you are to pick up your sons at their house then they cannot charge you with trespassing. Just present your court order to the judge and plead not guilty. If there is not a court order but have done this before then find all the witness you have (including your sons AND their mother) even if she is not willing and use that to your advantage. You have every right to see your kids and not have to deal with him. The best thing to do now so you do not have to deal with him is to make arrangements for both you and the mother (alone) to meet at the police station for pick up and drop off. That way you are protecting yourself from anymore possible charges. If she does not agree, take her to court to order this. As for having a case, I would think you would. You could use the facts that you were there to pick up your kids, he should have had the dog put up. I'm sure he knew you were coming. Talk to a laywer!

What a jerk. I know how it is dealing with the spouse of an ex (but maybe not to this extent). I hope he gets his ba**s ripped off by his own dog. I would say more, but everyone else seems to have summed it up - you've got a case. Good Luck and get well soon!!

P.S. While you are still in the hospital I would start contacting lawyers in your area. You should be able to find one that will come to the hospital and give you a consult free of charge. That way, he can see for himself how bad things are.

Pictures, lots of them. Blood, gore, the whole 9 yds. If you can make a juror puke then your more than likely going to win, even if you dont have a legal leg (sorry for the bad pun) to stand on.

i think so bc he actually ordered his dog to attack. He should at least be responsible for the medical bills. That is messed up, I hope your leg gets better.

You should have a court order to show that you were there legally.
