three teens damaged personal property and the total amount of the damaged is divided equally between all three teens. Two of the three are going to detention homes leaving the third out on probation. The third wanted to pay his total amount of restitution but the court informed him that if he did he would then have to pay the restitution for the other two boys....They explained it would become a civil suit...can someone explain that to me? Why if one child paid his share can he made to pay the others share?

The person damaged can sue one or all of the teens for the damages. So yes, the one teen could be sued and forced to pay the whole amount. That teen could then, sue the other two for their portion.

Is the restitution court ordered? If that's the case, all three should have to comply with the court order.

In any event, the kid should be made to pay his share. It's only right that he pay for his share at least. Maybe the person damaged won't sue him for the rest and only go after the other two.
