Consult with a few different personal injury attorneys who work do product liability cases (that's who usually handles this type of claim). Don't focus on who has the most wins or gets the greatest rewards. Do an honest assessment of each lawyer and their qualifications. The guy with the fancy office, big staff and bells and whistles has HUGE overhead....that clients pay for. They still may be the right person for the case...but shop around a bit.

Also, google around on the product and see if there are any class actions already out there for this product.

Wal-Mart and the manufacturer may both have liability. The issue is negligent. The manufacturer may have neligence in manufacture, design, failure to warn etc.

Wal-Mart may have been negligent based on there knowledge of the defects with the product and the likelihood that persons would be injured by the product and they sold it anyway.

Most Product Liability attorneys will join all possible negligent parties if he can establish a colorable cause of action for each. At the end of the day, if you have a legitimate suit...you want to join all possible defendants.

Were you injured by this product or did it cause damage? If it's just something that broke...that's not really lawsuit worthy unless you have injury/damage based on the product's defect. A single product may not necessarily have a defect that is lawsuit worthy if it was a fluke with the one you had.

You need to consult your case with a product liability lawyer. He/she have the better knowledge of law and can really guide you. I don't know your location so can't suggest you. You can also Google to find a local lawyer in your area. I know one law firm Mark Schiffrin PA that handles all type of negligence cases including product liability.

Wal Mart does not make products. It buys products from manufacturers some with their name attacked and then sells them in a retail environment. Your claim is not against wal mart for product defenct.

By the way thanks for raising all our prices and making another lawyer rich. That is just what society needs.

well i would say you need a damn good one cause walmart has some very good lawyers but you need to find one who practices product liability, and you might want to go after the company who made the product also.

Why not try to settle this out of court. A lawyer will take one third of your compensation.
