BUt is it illeagal to send it? What makes it spam? What if you are a ligit person tring to sell a product, is that considerd spam?

if the message is unsolicited then yes it is spam (Stupid Pointless Annoying Messages)

Spam is any kind of mail sent to someone who didn't ask for it and did not want it...
Doesn't matter if you are legit...
If I don't want your product and you sent me an email all about it, I will spam your mail...
You do not know my needs or desires, so unless I wrote first and asked you to send me something, then it is considered spam...

If you're really good (or have a good lawyer), you may be able to make case in court suing them for causing annoyances. But the problem with spam is that it's hard to track down who sent it.

No it's not annoying to me. It goes straight to bulk and then i click empty-never have to see it. If it's legit, let people come to you or pay for advertisement.
