In most places, it is a felony for which you can get life imprisonment and/or the death penalty. In other places, it just means you get more than 40 years.

As the last poster said, it depends on the state. But here's what I found:

For Arkansas:
http://www.iejs.com/UAM/Criminal_Law/arkansas_crime_classifications.htm

§ 5-1-106. Felonies
(b) Felonies are classified as follows:
(1) Class Y felonies;

§ 5-4-401. Sentence
(a) A defendant convicted of a felony shall receive a determinate sentence according to the following limitations:

(1) For a Class Y felony, the sentence shall be not less than ten (10) years and not more than forty (40) years, or life;

It looks like it's one of the worst felonies in Arkansas, so I'm going to say it probably can be for drugs, murder, rape, etc.

Most criminal law is state by state. Without the state, no one could possibly know. Your question is flawed.
