No, it is not legal to pay somebody below the minimum wage. It doesn't matter whether or not the person gets tips. The person has to be paid based on the minimum wage. Anyway, average weekly paycheck depends on what type of restaurant and how many hours do you work in a week. The pay can range from $8 to 15 an hour plus tips. Employees are supposed to report the tips earned too. If you work for an expensive restaurant most likely you will get a lot of tips. So try to find out how much is the average tip and you add the hourly wage and minus the taxes and any other deductions.

It entirely depends on how much you are claiming in tips.

I'm assuming by Bay Area you mean San Francisco. CA is one of the only two or three states that doesn't have a tipped minimum. This is good. It's even better because CA has a higher minimum wage.

Nonetheless the more money you get in your paycheck the less money you are making in tips. If you're working in CA, only claiming your credit card tips, working 5 shifts per week and only getting a $20 paycheck every two weeks you're doing pretty darn well in tips. When I was working in CA I made $200-$300 per shift, claimed all of it (looks better when you want a loan), and still got about $40 every two weeks in the form of a paycheck. In MA (where tipped minimum is 50% of federal minimum) I only ever got a paycheck when we were snowed in during the winter. The taxes taken out of my paycheck for the tips I claimed were more than my hourly wage. Actually getting a paycheck worth anything meant I made crappy tips.

We make our money in tips. If, in CA, we get anything in our paycheck it really is just cake. Outside of CA, if you regularly get paychecks that don't say $0.00 you may want to look for a better job.

Actually it is legal to pay them less then minimum wage, as they receive tips. These are usually part time jobs, so that they do not have to pay for benefits, so it is hard to determine a weekly pay check. Pay is from 5-7 an hour, but tips depend on your skills, they could be 10 an hour or 100.
