This applies If the marriage was made in the UK

you can obtain a divorce of the factual ground that you have been separated for five or more years (wife does not have to give consent) OR becuase you do not know here whereabouts you could get the divorce on the fact that she deserted you two or more years ago *

Get to your local county court and ask for a form D8 Divorce petition and guidance notes. *Tell them you do not know wife's address

Complete it and take 3 copies to county court and pay a fee approx. £350 - £410 or alternatively ask for a form X160 to see if you are el;idgble to waiver fee

Should take about 6 or 8 weeks to divorce from there

You need a lawyer.

First, you need to find out the status of the original proceeding. I strongly suspect it has been dismissed for one reason or another, but you need to know for certain. If it is still active, even if the rules of procedure call for it to be automatically dismissed, anything you do in another action can be voided on motion.

Second, you need to make a reasonable investigation to find out whether or not your "spouse" might have had you declared dead or filed another divorce. If you've been abroad and out of touch with her for that long, that's a possibility.

Only after doing those two things can you safely file a new divorce action, or your situation might qualify you to have her declared legally dead.
