I'm assuming you own the property and are trying to evict a rommate.

If you have cause to be "scared" of a rommate, a judge MIGHT grant a restraining order to keep him or her off the premises in much the same way it is done in a divorce. But merely being "scared" of the roommate is not going to do it.

As for eviction, if you dont own the property, you dont have the right to evict the roommate. If you do, you would have to follow the landlord/tenant laws of your state. If the roommate is paying rent, not breaking laws etc, and there is a lease,, you cannot evict him as a general rule until the lease is up.

If he is not paying rent, is breaking laws on the premises, is a nusiance etc then you need to serve him with a Notice to Quit. This is a legal document that you can find at a stationary store. It must be served by a Marshall, Sheriff or process server. You cannot just hand it to the roommate.

This starts the eviction process. If he does not leave within the time stated...as little as three days...you can sue him in an "Unlawful Detainer" lawsuit. You may want to use a lawyer for this.

If you win your case, depending upon your state, you can get this person out within a month or so. Some states longer. MUCH longer.

That's a general answer. But I caution you that being scared is seldom a reason for eviction.

More detail is needed. However, if you are renting the house or apartment and your name is on the lease, and the roommate does not have a written sublease, then the roommate is a mere licensee in most cases. A licensee can be evicted by changing the locks, putting his stuff into storage and giving him the key to the storage facility. How you do this given how scary he is, that's another thing altogether, but this is the basic theme.

If you're evicting him and are afraid of him...eviction isn't enough : even if you get him out, he knows where you live.

Pack your things little by little, change all your correspondence address and try not to arouse suspicion.
