It is murder many times .The death penalty is barbaric and uncivilized and murder many times .Today prosecutors with unlimited resources ,courts that are biased to govt and police .Defendants that most times are forced to use a govt public defender .People are guilty as charged there,is no justice in courts today .(justice > An impartial judgment based on truth fact and reason )Police are allowed to lie with immunity for doing so .Judges don't tell juries about ( jury nullification ) If judges are impartial why wouldn't they want people to judge the laws they have to live by .Our courts are not impartial or based on truth .200 people to be executed on death row have been freed because DNA proved they were innocent . Who takes responsibility for the innocent people murdered in the name of the law before DNA

Murder is the illegal killing of another human being.
A murderer who receives the death penalty has had a trial, has been found guilty, had a chance to present evidence as to why he should not be executed, and has had time to appeal his case.
A murder victim was killed for no legitimate reason, was not afforded a trial and had no chance to appeal the death decided on by the murderer.
To truly believe that they are the same, you would have to believe there is no difference between imprisoning a criminal and kidnapping.
The difference is due process.
And for those who stated that any killing is murder, would you feel the same way if you were being murdered and had the means to defend yourself? Would you defend yourself or would you let the murderer murder you and even your children if they were with you?

the death penalty isnt concidered murder because under the constituion they are afforded the right to counsel, they do plead their case in open court, and it is desided openly, after which there is a chance that the penalty is death by lethal injection, essentially yes you are killing a human being but their argument is that its through the legal system and since they are afforded due process its legal and therefore just, whether its actually just is really not something that can be determined but they insist that it is.

Technically it isn't considered as murder as stated in law...but, if you are considering the side of "taking one's life" everything falls on the same category. Nevertheless, the government has to invoke this to have a penalty on killing someone.

Our justice system tell us that "The only one who's above the law is law itself.... " and so it changes itself accordingly to what it wishes to become....
but the thing that's wrong here is that murder in any form is considered immoral under the universal law (ethics), and death penalty is a solution created by man which is under human law... a law that is as uncertain and erroneous as man himself and so if u classify this act under the universal law, it would still be a form of murder.

becuase murder is illegally taking of a persons life without cause.
A person who has been convicted of a capital crime and sentenced to death has had due prosses and sentenced under the law to death. Just as self defense is not murder neither is the death penalty.

This doesn't answer your question, but maybe adds to it:
Capital punishment is a statement that killing a murderer is justice. Now, say you saw someone commit a murder but he gets off because he bribes the judge, frightens the jury, or has a mega lawyer. If you then kill the murderer, you would be doing what has been declared to be justice ... but you would be subject to capital punishment for doing justice!
Just a thought, but I hope it helps provoke some thought in others.

I agree with Steven, it's a shame our government can get away with legal murder just because the men in suits said it was OK.If you take a life it's plain murder, we are not suppose to decide who lives and who die.
