I live in a Townhouse and there is a HOA here and one very mean member who won't leave us alone! We are a quite family of 5 with 3 boys in grade school. I don't understand why they don't like kids but they have made it clear they don't..Does any one no what I can DO to fight them one some of this stuff they've been doing???

Is your problem with this individual person or with the HOA as a group? If the problems are with the individual only - then go to your HOA. If the person is reporting false problems to the HOA - then you should have the right to respond to those complaints.

Do you have a copy of the HOA regulations and bylaws? You should have gotten that when you moved in. That will spell out what legal rights you have.

The first step would be to go to the HOA and ask what can be done.

The next step would be to see an attorney.

My parents live in an HOA also, they have a bunch of rules and it drives them nuts! They have complained ALOT to the HOA office. I think that you should just go talk to them, get a list of their lame rules, and if there is are not any rules in there that you are breaking, take it up with whoever runs the place. In the HOA where my parents live, they have a rule about where you can park your car....it was really annoying. So, i know how you feel. Just call the HOA all the time, if you bother the hell out of them, something will be done about it.

Your covenants are a matter of public record. You should have been given a copy of these prior to your home purchase in most states.
If you cant find them go to the courthouse and ask to get a copy of the restrictive covenants for your subdivision or Townhouse.
Read them thoroughly. It is very hard to get around these as they are usually written by attorneys. In essence, you agreed to these terms when you bought it and there is probably a document stating such in the purchase papers. Mostly, you will have to learn to abide by these rules or move. These restrictions are devised to protect the value of the property, yours included. Unless they specifically go against civil rights, which is doubtful, you are obligated to comply.
If you feel a law is being violated see a Real Estate Attorney.

You need to have a copy of the by-laws of the HOA, and if they are harrassing you and have made that clear to your family and in front of others??? You can get your lawyer to send a nice/nasty letter explaining that unless the harrassment ceases that you will pursue every avenue you can to stop them or have them removed from the area. Get a GOOD/BAD lawyer to scare them and that should be all you need. As long as YOU guys arent breaking ANY of the bylaws, youre good to go! Good Luck!!

Write to the president of your HoA to describe the harassment you're enduring, or request a meeting.

Assume by HOA you mean homeowners association of the type mentioned here: http://www.cohoalaw.com/. Law is different in every jurisdiction. Where are you? Also, what's the nature of your beef? Think W5 - who, what, where, when, why and how much is it/has it/will it cost you?

I dont know, but I have learned the hard way about HOAs. They attract petty people who want to make themselves feel powerful.

If it was just one member and they refuse to leave you be, go to the rest of the association first. If that doesn't help, contact a lawyer. The police should be able to arrest the member for harrasment and/or trespassing if they physically come on to your property.

HOAs are just another way for people to butt into other peoples lives.
