I have been the primary caregiver of the child since he born , the father he didn't ask to see the child till the child was 6 months bcause i took him to the court , i have now the interm custody of the child and he has the access , the Jug miontened last time that the joint custody it's something far away from happning because there was a violonce against me when i was pregnant he abused me , Do you think I'll get the sole custody next court date ? The father is unemployed he's on ODSP(disability) he's lazy he doen't have any health problem .and there is no contact between us since the abuse happen he see the child in the access center supervised but it'll be unsepervised when we go back to the court ,
Do you see any chance for me to get a sole custody ?

What kind of legal help are you getting? I'd request continued supervised visitation unless he has taken anger management classes. If he has done nothing to "help himself" become a better parent, how can you be assured that he won't get angry at a baby when he spills the milk or something? It would help if you have anymore info on dad's drinking habits or other objectionable behavior. Perhaps you can request limited- daytime only, no over night visitations..
I hope you get sole..doesn't sound like the dad is very interested in the kid. Will child support be brought up at the next hearing?

The laws vary by state, but general laws says that if the father is paying child support, he has visitation rights and custody for vacations.
That can be changed by showing the father is a danger to the child. Past conduct such as assaulting you, excessive drinking / drugs, disorderly or violent conduct Will show that.
Obtain the services of an attorney. Usually the best attorney wins in these types of cases. If you can't afford one, check with your welfare dept. to see if they can recommend a law clinic or legal aid clinic that will help you.

Looking Good!! Don't think a judge would give joint custody to a man who has already proven he's violent. Obviously he didn't have any concern for his unborn child. Keep pushing and fighting for your son. Some men just aren't meant to be fathers!!! And to make it clear, some women meant to be mothers. I didn't want to get a thumbs down for picking on the male species!!!!

Sole custody doesn't seem to be an issue. The son will end up in your care. Perhaps what you need to do is have this dead beat waiver his rights of child support and then he won't have any visitation or legal rights either.
