You need a lawyer, not yahoo. If the house is in both your names, you're very much out of luck...even if that house has been in your family since the beginning of time. Sentimental value really doesn't mean much here...hopefully she's nice about it, but divorces can be nasty battles to acquire more wealth than your partner. She's probably eyeing the house as a very nice chunk of cash...you might have the option of spliting the value of the house, then you can buy her share of it...don't try to negotiate anything unless you're with a lawyer...if she's catty (as women are notorious for), then she may try to use prior negotiations against you in court.

you need to get a lawyer, but I'm thinking that because You both bought the house, you will either have to sell it and split the proceeds or you will have to have an agreement with her and pay her rent (to buy?) or buy the house (paying half the value) from her outright. Of course she may want to keep the house and if you have children that will complicate things.
Get a lawyer.

What do you mean do you get 1st right's to the house? NO you'll have to sell it and give her the percentage she is entitled to out of the sale money , same as with anything else you owned.
Go see a Lawyer.

I think it is community property. But if I was your wife, I would not want to live in the house where your mom died.

First rights if you want to buy her out. That is half the value of the house. Hey. That's not fair. Yep. But that's the way it goes.
Ipso Facto, Presto-Change-O and all that other legal rubbish.
Heh, heh...marriage. You still get screwed...one way or another.

That is a question you will have to have an attorney to find out. If you had or have children they may give the house to her for the sake of the children

I can tell you are in trouble already. Since you are asking this question to all of us instead of a lawyer you are asking for problems.
Run straight to a good lawyer if this is really going to happen and protect your self and the rest of your future.

Depends on who owns the house. It is probably jointly owned so you will have to find a way to negotiate. It may cost you.
