He wants me to help him find an apartment in vicinity. I hung up when he called and he called back leaving mess. If do not intend on talking to him,he wants all his stuff he did not want me to have. Which I donated the most of it to charity. Do to some of his past endeveor I am concerned about this. Legally can he do anything. Please someone let me know.

We need more facts: how long ago did your ex leave the property with you; what was stated by your boyfriend after he left, concerning the property; and what type of property was involved.

You have the defenses of gifting and abandonement.

!. Gift: If the items were given to you as a gift, then they are yours. If the items are very personal, i.e. a mink stole, then there may be a presumption that they were gifted. If it was a sofa, then it is less reasonable to presume it was a gift.

2. Abandonement: If your boyfriend left without stating when he was coming back; if your ex told you to hold on to the items, and he did not ask for them for a long period of time thereafter, you can assert the items were abandoned.

The court will look to the reasonableness of his actions and your actions.

Legally it is his property and he can take you to small claims court. Depending on your laws and how long he left it there after the break up you may be in the clear. If he waited like more than three months to get his stuff then he was considered to have abonded his stuff.
In the future just give everything back.

If it was his stuff and you did not properly notify him to pick it up and give him the time allowed by law (30 days is pretty common) he could sue you for the cost of replacing the items.

You can not legally just throw out peoples things just because you no longer like them.

David and susie are correct. By not notifying him to retrieve his belonging, or by accepting them, you created what in law is called a 'bailment'...an agreement to care for his belongings.

All you had to do to protect yourself is to write a certified (RRR) letter to him telling him to retrieve his belongings within 7 days (or a reasonable time) and failure to do so would be considered by you as permission to dispose of the items.

You did nothing and therefore, he can seek recovery for your actions in small claims court (if the value of the items fits your local laws) or in a higher court if the value of the items exceeds small claims limit.

If you did not object to him leaving those items at your home when he left them there, and you did not notify him to pick them up (and allow a reasonable amount of time to pick them up) - then yes he could have recourse against you.

Depends on your local law. He will need reciepts for all of it to prove its worth. He must also have proof that he left you in charge of it with the intent to retrieve it later. I would not worry about it. You must be honest with him tho. YOu will need to tell him that you gave it away.

He can try suing you in Small Claims court but he'd have to have proof that he asked you to take care of his stuff. He'd probably have a hard time winning his case.
