If I take what is called a loan from my 401k when do I pay the tax burden?

If you cash out, you are subject to federal and state taxes plus a 10% penalty on the total cashed out.

If you take a loan, you make payments (principle + interest) back to your 401k account. It's not subject to penalties or taxes. If you default on the loan back to your account, then you will be subject to the taxes and penalties stated above.

If you cash it out you pay a 10% early withdraw penalty, and then you have to pay regular income tax on top of that. With a loan there is no penalty and no tax impact. Although the payroll deduction for a 401K loan is made after taxes are deducted.
