It is mandatory that you are taken before a magistrate who can set bail or release you upon a written promise to appear. (Vehicle Code section 40302, subd. (b).) You are not supposed to be taken to jail if a magistrate is available, but many police officers fail to observe this requirement. Since the ticket is only a written promise to appear, why not sign it?

You can get arrested. You are just signing acknowledging you received the citation. You are not agreeing with the content. There's no reason to refuse to sign.

Nothing, they just write "refused to sign" on it. You're still responsible for the ticket, court date, etc.

Why not sign it, you are told that you are not saying you were guilty or innocent of the traffic violation.
