Scenario:

You find that everytime you put your food in the communal fridge, someone steals it. So you poison it. Person steals it and eats the poisoned food. They die. Somebody finds out it was your food.

Are you liable? Aren't you free to do whatever you want to to your OWN food?

Yes, it's murder if they can prove that you had reason to believe that person would eat it.

EDIT: In the very least, it would be reckless endangerment (even if no one ate it) since you're putting everyone at risk.

I would say yes to the first two questions and no to the last.

1. I know that it is illegal to set up a booby trap in your house designed to make a gun to go off and shoot burglars.

2. There are laws regulated how poisons must be stored and how they can be used. Not having a childproof cap on the poison is illegal. Using certain substances, including most poisons, in a manner not consistent with the manufacturer's label, a doctor's prescription, or what the government has approved, is illegal.

3. Doing anything for the purpose of causing someone to die is illegal with very narrow exceptions, even if it is something that would otherwise be legal. For example, while you generally have the right to say that you disagree with the President, you are not free to do so for the purpose of distracting a guard so that someone can rob a bank.

Well a murder charge would require intent. The entire purpose you put poison in the food was because you knew it was being consumed by someone else so you aware of the fact that someone else was going to eat it and get sick or die.

It'd be pretty hard to argue that you were intending to enjoy some poison yourself.

At the very least it would be criminal negligence causing death,.

If the person put the poison in his food intentionally and didn't tell the people he shared the fridge with, then Yes he would be liable of Negligence. Sure you can do want you want to your food, but when it comes to sharing a fridge full of food then you must be responsible for it. besides who would want to test someone to the point where it could cause death? Sad!!

Yes its murder. You chose to poison your food knowing that someone would take it and consume it. You can do whatever you want to your own food without the intent to harm others.

You poisoned the food with the intention of killing the thief. That is premeditated murder.

Yes. It's murder. You are not allowed to intentionally kill someone.

And no, you cannot do "whatever you want" with anything. You cannot shoot your own gun where ever you want, drive your care where ever you want, etc.
