Im in no way condoning what Craig did but just last weekend there was the Folsom Street Festival where people were actually committing the acts in public and I didnt hear of an arrest. How can a guy in a stall be arrested for tapping his foot and two guys can dress in bondage and whip each other in the street in front of kids and people think its a good thing.

R = expectation of a generally acceptable personal code of public conduct

D= morally bankrupt- the more offensive (apparently) the 'free-er" the speech.

Where this matter takes on a higher level of scrutiny is that Public Officials should be held to a higher standard than that of their constituents. It goes with the job, personal integrity and decency should always required of elected officials. What was done or perceived in that bathroom is not befitting of a elected official. What is publicly displayed in gay parades is revolting and disgusting. I think Craig was framed but I wasn't there so maybe he just used poor discretion. What I do have issue with is that given his years in Govt and legal background why didn't he know how to plead. Anyone that inept on legal process shouldn't be representing others. As for public lewdness laws there are likely exemptions for parades. If a male female lewd act is in public an arrest would probably occur. Gay lewdness might be overlooked during an advertised and permitted event as police officers may fear becoming labeled as homophobic.

It depends on the city laws and what is considered a act of art or expression. There are universities that actually allow students attend class nude. In more liberal cities you will see this not being considered lewd but in more conservative cities they would be arrested due the laws on the books.

I am not gay, and never have been. I am the victim of a witch hunt... A witch hunt against people that eat a lot of fiber.

Because I eat a lot of fiber, I have to take a wide stance when I take a massive dump. The wide stance increases the power I can bring to bear. And honestly when that turd just won't cooperate, I need every megapascal of pressure that the wide stance affords me.

Apparently, in some perverse circles, taking a wide stance in a public bathroom is somehow indicative of a request for sex. Can you believe that? It's so disgusting!

When I'm really applying the intestinal pressure, I shake and tap my foot. It's absurd that such a completely normal reaction to the stress I'm putting on my body could be misconstrued as requesting sex!

And when I really have to go deep down inside myself to force out a monster turd, I shout phrases like, "I am requesting gay sex!" How my shouting of the phrase, "I am requesting gay sex!" could ever be construed as a request for sex, I'll never know.

I believe this is set by the individual state/city. I actually work in a small town in VT where public nudity is allowed downtown.
