okay, my b/f was in a wreck last friday...no one was injured, and everyone drove away from the scene, went to another location and talked it over. the accident occured because he was exiting a highway...while on exiting, he noticed that car B was trying not to hit car A, but car B hit car A. he couldnt move over to other side because its an exit ramp and other cars were coming up behind him, so he slammed on his brakes, hitting car B. keep in mind that car B hit car A. car B damaged her front, while my b/f (car C) damaged her trunk. car C's hood and bumper was smashed. how will the insurance determine who was at fault. it was his understanding that he would help to fix car B's trunk, and she agreed, but now they have called our insurance company and filed a claim. i think that car B should be responsible for her front damage and not rely on our insurance to pay for the entire damage. we didnt call our insurance company because we are paying for our own damage. any advice will help.thnx

i dont know where car A stands in this because his truck wasnt damage at all.

Your boyfriend is at fault for the second accident, where he hit the rear-end of car B. He was following too close and did not allow adequate room around him.

The driver of car B is responsible fort the first accident, where he rear-ended car A.

In a rear-end accident the person that rear-ends the other vehicle is almost always at fault. The only exception I have ever heard of is when the car in front backed-up and the two cars collided.

You need to contact your insurance company ASAP. Depending on the speeds involved, you may have to pay a share of the front end damage to car B. This is because if you hit the rear-end of car B hard enough, further damage could have been caused when they were pushed into car A again.

I hate to tell you, but once the police put all of this together, you are going to be looking at possible criminal charges against both you and your husband. You lied to the police & said you were driving (filing a false police report), your insurance is lapsed (driving without mandatory insurance), failure to change addresses on your license & registration within the 30 days required by law. If this blows up in your face like it very well could, I hope the bus runs out by your house, because you may just be looking at needing to memorize the public bus schedules or taxi company phone numbers for quite some time. Because the police will press charges & the DMV will be asked to suspend/revoke yours and your husbands licenses. And it doesn't matter what state you are in, the penalties can include jail time. You said you had a small child- if you and your husband both end up in county jail for a few days, weeks, months- you are going to lose your child. You do know that don't you? So you had better hope the cops investigating & the other person's insurance company employees are about as bright as a burned out light bulb & not the intelligent, well trained police officers I work with.

Well considering you all left the scene will be hard to get a police report accurate.

But it would go one of two ways. Either he will get hit with a ticket for hitting the B or else the car B will get hit with it all for being the starter of the accident.

I have been in a few accidents and 1 was similar to this and I was hit from behind and slammed into another but because I was hit and thrown into someone else it was not my fault.

So in my opinion your BF was trying to avoid it but got caught in it so technically it should not be his fault.

if the cops were not called it was a big mistake because now he left the seen of an accident the people who called your insurance company will get there car fixed and probably more because they can claim they have a injury never the less the insurance will go up. In the further you B/F should call the cop's even if it was just a bump to protect himself

was car A in the middle of the high way so then carB had to of hit carA if it was in the middle of the high way
