I just recieved a call from the prosecutors office saying my ex says my son lives with him 50% of the time. But he only is there 6 days out of the month. My brother watches my son so I don't have reciepts for all the daycare expenses. Now he says he is getting a lawyer to take it to court. Any advice?

I don't have the funds to hire a lawyer. He won't even pay half of the childcare anymore.

Ok it is not a custody case that is why the prosecutors office is involved it is for child support. I contacted the prosecutors office back and they will be represnting me and they said I just need reciepts for the childcare or this form they are mailing me.

You have witnesses like your brother, other relatives and friends that can verify your story. Start keeping a diary with days and times that your son is at your husband's house. If you can start making him sign a sheet of paper when he picks him up and when he returns him or start taking a witness with you like a family member or friend to verify it.

Make sure you are following the court ordered visitation to a T. Your husband can't prove it any more than you can.

if your brother is physically present most of the time, he can testify about how often he babysits, and how much time he spends with you and your child...

maybe you could consult an attorney. they do give free consultations sometimes (family law attorney).

i never heard of the prosecutor's office being involved in a child custody case.. did someone break the law?

sounds confusing to me.

submit a WRITTEN statement from your brother to the prosecutor's office and send a copy to your ex's lawyer. That should cover you if this goes to court.

Document it. Write everything down- which times you have him that you are supposed to and especially the times that you have him when your ex is supposed to.
Color code them and do it in your own handwriting- i.e. get a notebook just for documentation of visits and other things that have to do with custody. Write down your regular time with him in blue or black ink then the extra time in red. You could even use a highlighting system if it's easier for you. If you have a friend, neighbor or relative that sees you with him regularly then have them sign off as a witness.

call the prosecutors office and ask them what they need from you in order to prove that he lives with you this often.

get a lawyer too and be really carefull what you do
ask your brother to testify
