I live in an apartment now with MOLD in the basement And The landlord was STEALING electricity from me of course I notified ppl and local authorities but this guy is a "SLUMLORD" by no means a landlord. He also tried stealing my power drill AND sucessfully stole my car ramps-That I USE to change my oil. I also have NO FIRE ESCAPE and carpetiong in the kitchen and bathroom thats moldy underneath. I have only one heater in this apartment that is from like the 1970's and it chewed up 150.00/ month I asked him for a new one but never get an answer. I am so fed up with him. NEXT I do not have a lease with this guy NO contract what so ever. I lost my job 4 months ago and have become 2 months behind on the rent. I did not give him security when i moved in either. I want to move out What kind of trouble can i get into if i just leave? After all he has put me through I dont want to pay the rent my apartment is falling apart. PLEASE HELP ME.

Even if you leave, he can go after you in court for past due rent, late fees if any, and court costs. Pay your rent, he is intitiled to it even though there are problems. Otherwise it will go on your credit report for 7 to 10 yrs. Also I am assuming you notified the local authorities and the landlord in writing, so that is proof you have tried to take care of it.
In your defense, you can take pictures of the problems and take them to court with you. If what you say is true, then you will probably win your case. Having no contract with the landlord just means that you are a month to month tenant and must give him 30 days notice of moving. He is also intitled to that months rent. If you do the right thing, it will make him look bad.
I hate landlords that make us good ones look bad.

I would suggest checking with your local housing authority ... Or check with some type of free legal aid service ... to see
what YOUR legal options are.

Landlords are required (by law) to maintain the dwellings in
live-able and safe conditions. It does not sound like your landlord is doing that.

Also ... if you have proof of the landlord's criminal activities
(stealing electricity ... and your car ramps....) Then THAT may
be another issue that you can address.

Anytime there is an ill-maintained or unsafe building ... Tenants Have RIGHTS! (Also ... there is a proper procedure
for handling your rental payments under these circumstances.
You would put the monthly payments in an escrow account
until the violations have been resolved ... but you need to
get competent advice on how to do this in your State!)

Again ... Find out what your legal recourse is ... As a TENANT
you do have RIGHTS!

If you DID NOT sign a lease .... you "may" be able to just
leave ... But I am not sure .... Because you were living there
and paying rent ... So that "may" be an "implied contract"

By law, you must give a 30-day notice so the landlord can prepare to rent it to someone else.

If you just leave, you will be sued. And all the judge will care about is "I've been out of work for 4 months," and "I'm 2 months behind on rent." Those facts pretty much cancel out all your above complaints. Apparently you had no problem with the apartment till you lost your job.

If you reall want to prove all those issues, you need written proof that you've been asking him to fix the stuff. But either way, law says you have to give him a 30 day notice.

Just leave and do your Landlord a favor. In fact, why are you still there? And by the way.... $150.00 a month is dirt cheap, so I don't feel too bad for you at all. Funny how people like you always seem to keep their Internet connection and computer after losing your jobs! Do you still smoke, drink, and have cable TV? I bet you do, and it's funny how your type seems to hang on right up until it's court time before you move on to rip other Landlords off. You story is typical so don't feel like you are all alone in this crazy world of non-motivated leeches. Kudos to all the self induced under-employed! Funny how it's always the "Big Bad Landlords" fault. Take responsibility for yourself and get a real life.... you'll be happier!

Be sure you document what you are living with and all the problems you have (including pictures). Without a lease and since you are already behind in your rent, I think the landlord will be happy to see you move. He may try to get money out of you but you will have proof of why you were forced to seek safe and healthier living conditions. Watch your credit report though because the landlord can make a bad report on you which will cause you problems renting in the future. If this happens, you are entitled to dispute it.

You really need to get out of there because of the mold. Depending on where you live, even though there is no lease, it may then be considered "month to month". You should also report him to the Health Dept. about the mold and get a written report from them and that might give you a "Legal" leg to stand on if he chooses to sue for the past rent. But GET OUT OF THERE!!!!!

you should leave for sure. thats no good for you. i would just tell him you are leaving and see what he says. if you have filled out no contract and havent signed anything you shouldnt have to worry about a waiting period. but since this guy sounds like a dirtbag he might try to cause you problems so i would talk to him so that if he has a problem you will know then instead of him bringing up something later. dont stay its no good.
