if she was still legally married your marriage is null and void.. i dont know how u have to rectify it.. so i guess u would need to discuss things with a lawyer and find out what to do now.. possibly could be as simple as renewing ur license and vows..

In most states, your marriage to your wife before her divorce from her previous marriage was final, would be considered "Null and Void," especially if you knew that she was not finally divorced. It is null and void because it is considered as bigamy. On the other end, if you did not know and had "believed in good faith" that the marriage was valid, you could be considered a "putative spouse." This term is used in community states when division of community property is at issue. But since it sounds like you just want to rectify something wrong, I suggest you call or talk to a family lawyer to advise you on whether filing a Petition for Nullity of Marriage is necessary. However, you need to remarry to make your marriage legal.
Hope this is helpful.

Do you mean that you got married before yours and your wife's divorce was finale? If you did you better get to the court house to fix this. I recommend that you go and fix things that can come back to bite you in the rear when you least expect it. They will not put you in jail or anything like that but all the paper work and all the legalities of it will be fixed. Go to the court house and explain to them what happened. They will tell you what to do and they will have all the right answers for you.

The marriage isn't legal if either of you weren't divorced/single when it occured. Typically a marriage license can't be acquired without proof that both parties are eligible to marry.

Go down to the courthouse (or call them) and find out how to handle things...it's likely you'll just have to do it again (marry) when she's eligible to do so, and that date will be your actual date of marriage.

Check with the courthouse or attorney first. From what I remember it all depends on how long ago your ex claimed to have filed divorce papers. I would ask an attorney, most give the first consultation free.

You should get married again. She could not be married to you legally unless her divorce was final. Make it legal.

Only Islam allows the marriage of a second partner while the first one is in the process of divorce.

Bigamy - You should have given divorce papers before you got married, in UK you have to put in your bands 6 weeks before marriage to enable them to check you out and produce divorce papers.
