Really it is an outdated arguement. With conservatives having more seats on the Supreme Court... wouldn't they have over turned Roe vs Wade by now if that is what the Republicans wanted?

If they did, they have the 5 judges that would do it

I'm just going to repeat what others have already said.

From user Dialectic
"Where are you finding that it's the Democrats that are bringing this up disproportionately? In my experience, it's been somewhat the opposite. Just wondering why your experience is so different than mine. "

From user Holy Cow:
"We don't. Why do cons keep bringing up gay marriage even though it's already banned?"

Here is TX we have 3 laws and a Consititutional Ammendment that bans gay marriage. Nice to see the Lege using there time well.

The Supreme Court will not overturn Roe v. Wade. They have upheld the new law that bans partial birth abortions except in cases where the mother's life is at stake. It should be a non issue with people seeking office in the Executive branch when this is an issue for the Supreme Court. Appointing pro choice judges will have no effect on this issue because a precedent has been set.

They need the proper case to be brought before them, one that has climbed up the federal ladder to reach them.
The next president will decide for years to come who sits on the bench. A conservative will have the ability to keep the court conservative even if the country has tired of it and has gone more liberal. Its like having a bomb in place with a delayed detonator.
Its not at all outdated, it could come up at anytime, all they have done to date is chip away at it. Like saying that the life of the mother can't be ignored when you write the law.
But the health of the mother can be.
The Republicans don't really want yet one more thing that is unpopular blamed on them, and for most of the non yelling public, they want safe abortions available in at least the first three months.

Good question. If Roe v. Wade were overturned today, women would still get abortions. They'd do it in back alleys with coat hangers if necessary. Many of them would get infected, and the abortions would be more barbaric. Some of those women would get arrested for murder. Others would be forced to have children since they had no other options. As bad as abortion is, stopping it immediately has serious consequences. A realistic solution would condition the population to be responsible for its actions so the transition to illegal abortions is a smooth one. This is not something you could effectively do quickly, and I think Republicans know this.

If they were to overturn it quickly, they'd get blamed for all the bad things that happened. It would be reckless and political suicide. Abortion would be re-instated instantly, and debate on the subject would probably be considered closed.

There is a substantial portion of the Republican base that vote strictly on this one (1) issue based on their faith. If the Republicans were to have the ruling overturned, and they have had a majority of appointees on the Supreme Court for over 2 decades, then Republican Candidates would have to get the votes of these people based on the issues. If Republicans have to run on issues rather than people's fears, they are going to have some difficulty getting elected. It is in the Republican Candidate's interest to continually bring up this wedge issue without doing anything about it. I don't see where "Democrats keep bringing up abortion."

The Justices of the Supreme Court, once confirmed, answer to no one. Not democrats, not republicans, not the current President or the President who appointed each individual, and not the changing whims of the American people or special interest groups. The Justices of the Supreme Court answer only to the US Constitution.

And I agree, if it were to be over turned, it would have been by now.

As to why democrats keep bringing it up... it is a divisive issue, and it's almost election time.

I don't think they do.
its cons/GOP who try to limit a woman's right to her body and medical choices and then the Dems/libs respond.

even now in my state a planned parenthood clinic is opening and its con/GOP who are making a big deal out of it.
90% of the medical care provided at PP has nothing to do with abortion. they provide care non-rich women need

the supreme court defends the constitution and the law- they don't legislate political views

Democrats are playing politics with this issue. Rubbing salt in the wound of pro-lifer's who haven't seen anything done. Trying to divide the Republican party.

A case or controversy needs to arise giving the S. Ct. jursidiction to visit Roe v. Wade. I think this needs to come from some State's narrow abortion laws, and probably will.

The Democrats as well as the Republicans will bring up any topic that they think will get them elected. Remember that they are politicians and lawyers. They will do anything to get the cushy government job and the great retirement benefits.

It is very close to being overturned. One more justice and it could go by way of the Dodo Bird.

The other reason is, there are powerful voices on the right that want it overturned.

Just a way to keep the heat turned up on both sides.

Peace

Jim
