I got bitten by my own dog in Petsmart while the vet do the shot for my dog. They took my dog into some backroom do some checking at first. after it came out, it get really aggressive. then the vet said it needs another shot. and ask me to put the muzzle on the dog which they provide. But it seems my dog hates the muzzle and bite my hand. Then the vet said lets not put the muzzle on and hold the dog in arm while she put a shot at my dog. while i holding my dog. it bites my lips and my lips split into 2. i need to goto hospital and have 8 stiches on my lips. I cant goto work because i am salesman and i cant talk with 8 stiches on my lip. so my question is can i sue petsmart and if i do how do i find a lawyer

they did some shots in the back with my dogs to get her so aggresive first. Also they took the muzzle off after they took her out the back room

yes, this is a case of negligence. The vet did not take precautions that a reasonably prudent vet would have taken in the same circumstances to prevent your dog or any dog from causing harm. It is forseeable that dogs who don't like shots or dogs placed in unfamiliar situations may feel threatened and blindly retaliate. Todd Crawford, Esq.

You had you OWN DOG in your OWN hand and YOUR OWN DOG bit YOU and you want to sue PETSMART??? hahahahahahah oh please... If you can't control your dog, that's YOUR FAULT... had the dog bitten the vet, the VET could have sued YOU so I'd consider yourself LUCKY and be a bit smarter the next time. I've owned a few dogs in my life time INCLUDING GERMAN SHEPARDS and have NEVER been bitten by my own dogs at the vets or anywhere else...must be the dog just doesn't like you as much as you thought.... Seriously though, of COURSE this was NOT PETSMARTS FAULT.... suck it up and next time the dog needs shots, give it a DOGGIE DOWNER before you grab onto it to hold it down again for a shot...

my daughter had the same problem with a ferret..the pet store told her that if she had a necropsy done on it and it proved that the ferret died from a preexisting illness they will replace it.. pet stores cant b 100% sure an animal is healthy when they sell them cause there could b some underlying illness.. sorry about your guinea pig but whenever you purchase a pet from a pet store youre taking your chances.. theres no grounds to sue..

You cannot sue Pet Smart because of your poorly trained dog's actions.

If you're going to sue anyone, sue yourself. It's all YOUR fault.

Be a man and be responsible for your shortcomings in the dog-training field.

This in all depends, of course it depends of your state law, and in regards to the procedures Banfield Veterinary Clinic is supposed to take under this situation. Also, you would not go against Pets-Mart, you would of course go against Banfield Veterinary Clinic (If that is the Vetanary Clinic in the Pets-Mart you went to).

If I was you, I would take this case to a Litigation Attorney, and give them the details of your case, and see if it is worth litigating. I kind of do see Liability and Loss of Wages, but I am not a Lawyer to give legal advice, but this is just my opinion.

i would say no because it seems that the vet deliberately asked you to muzzle your own dog. but if you can prove that your dog is a VERY calm dog and never ever bites anyone then maybe you can prove that the shots they gave him aggravated him and you would need a good lawyer.

You wouldn't go after Petsmart - you'd go after Banfield Veterinary Clinic, which is the company that provides the vet services in Petsmart. They are a separate company.

As the owner of the dog, you are liable for the dogs actions.

Suck it up - sometimes crap happens and you don't get paid for it.
