I do yard work for my neighbor. She wrote me a check today, but I was turned away from the bank when trying to cash it.

They told me to "Go back, this check can't be cashed right now."

I assumed that there were insufficient funds in the account, and that I would have to talk to my neighbor and cash it at a later date. However, after futher inspection, I noticed that the date on the check was October 7, 2007. I tried to cash it today, on the 3rd.

Although there was a different date on the check, will my neighbor still get charged by her bank for me trying to cash it today? Is it the banks error for not noticing the date? If the bank tries to charge her, and she points out the date on the check, is it possible that the charge will be dropped?

banks will not cash a post dated check. You go back on the 7th and they will cash it, bring ID and they will cash it for you. Its not because of funds..but the date. If when you go back they won't cash it still..talk to your neighbor and get cash.

The bank isn't in error. Writing a post-dated check isn't legal, so even though she wrote Oct 7 on it, it's still a valid check and you as the recipient are allowed to cash it. Since it was just turned away and not accepted into the banking system, she might not get charged for it - if you had deposited it at another bank, and then her bank had bounced it, she definitely would have been charged a fee.

No, the bank looked up the account and there weren't the funds in there so they gave the check back to you. If you had deposited in your account and it took them a couple of days to process it, you would get a returned check charge and she'd get a bounced check charge. what she did is called post dating a check. Didn't she tell you that when she gave it to you? It's not illegal, she probably did that because she knows she'll have the money in the account by that date.

Your neighbor will be charged. Post dating checks is illegal. By signing the check she was saying that the funds were available. If the money was not there she should have drawn your attention to the date and "asked" you to hold it until the 7th. She was wrong to do that to you. Don't let her guilt you into feeling bad for her bad deed.

the bank can't cash it before it's date. this is called "post-dating" a check.

your neighbor dealt you a bad hand.

you were wrong, it has nothing to do with "insufficient funds".

no, that is why the Bank told you to come back later. If on the
7th you cannot cash it, then she will be charged a fee,
and you ask for cash and never take a check again

It was not accepted, your neighbor will not be charged. When the check is good in a few days you can try again.
