both my wife and me agreed to divorce and my 2 child custody belongs to me (husband). To avoid to the court hearing, what should i say on the petition of legal custody of children to? and what form do it need to attach with?

check your states codes on divorce filing proceedings. I know in most states you can file depositions taken in front of a notary public and avoid the hearing. Also in some, if you are filing no-fault you can state on the petition that child custody is not at issue and if the respondent doesn't contest on that ground, it will never be brought up. In any case in most states, it will be found in the civil code under domestic proceedings and/or filings. Your states code can be found online on the Lexus Nexus website.

I am not sure u can avoid one..

unless in total agreement with ur attorneys

they question is a bit confusing..
if both children are his.. child support has to be set.

if one child is his.. again u have to be in total agreement about everything.. support, visitation etc..

he has to agree to u having sole custody.. of the kids.
all state laws vary a bit.. so check at ur court house.

....and your question needs to be a bit clearer. Your "2 child" is yours from a different relationship? Or do you have 2 children? And what state do you live in?
