what is the smallest number of ppl in a room that would not share the same birthday?

This doesn't make any sense. It's possible that a room of 2 people or a room of 2,000 people could all share the same exact birthday. I think you need to reword your problem.

366 people could be in the room and none have the same birthday. One was born on February 29.

I believe this is the question you were asking, but it is certainly open to interpretation.
