Additional: Yes, you're right. It was determined by the supreme court to be a guideline. Nevertheless, though they might not like it, our supreme court's rulings end at the water's edge, and if international usage forbids it in time of peace, one might construe that the man who hoisted those 2 flags did so with hostile intent.

What did he do? No, I don't think anyone should go to jail for flying a flag over the US flag....that's stupid....even if it's flown upside down or something. Jails are too crowded as it is to lock people up for stupid things.
