Well, he's a thief. He should be prosecuted for theft and vandalism. Dragging a flag on the ground may be a protected act of free speech, but only if it is your own flag. Free speech does not give a person license to steal and vandalize other people's property. If he had bought the flag first it would be fine.

Yes, stealing is against the law. There are also laws that govern the use of the flag.
