It was just discovered that an employee is using a false ss# .... this employee worked for 3 months ... this employee passed a background check. Now that the company has been made aware this is an illegal alien, does the company have to pay final hours worked?

It would be illegal not to pay him. He worked the hours. Sounds like your company needs a better background check company. Who checked the two ID's required to hire him? (and signed the Federal papers) Almost sounds like the company is using illegal employees so they can challenge paying them.

They will probobly need it to pay the fine if they keep him. The employee has no rights here in the U.S. That may seem like a cruel answer but without law, we have nothing. Look at SanFrancisco, they don't have any laws and look what a joke that is.

If someone work they have to be payed. It does not matter their legal status. Common law will agree with me.
