I have a bill that is well past the statute of limitations. Asset Acceptance LLC continues to harass me with collection notices and telephone calls. How do I go about issuing them a cease and desist order? What steps do I have to take?

Use the following letter.

Re: Acct # [ACCT NUMBER]

To Whom It May Concern:

This letter is being sent to you in response to a CONVERSATION on [DATE]. As I do not recognize the debt in question, I am exercising my rights under the FDCPA to demand validation of the debt.

If this has already been reported to my credit report, I expect you to update the reporting to show that the debt is disputed, as required by law.

I look forward to working with you to resolve this issue and will be eagerly watching the mailbox for the validation I requested. I trust that you will have the documents mailed to me within 30 days of receiving this letter and will, of course, cease all collections actions until validation is provided.

Warmest Regards,
[YOUR NAME]

I was not aware of a statute of limitations on an unpaid bill. Getting a cease and desist order involves going to court and proving that you should no longer owe the particular bill. Your best bet is to simply ignore the collection agency until they stop calling and sending you notices.
