Thanks, talked to them, they are sending a tow truck and said they will fix the prob, I hope they don't come up with another problem and try to get more money. If they do I should take a another mechanic and have him check it out, right? Should have gotten rid of that piece of **** a long time ago!

I'd cancel the check, take the SUV right back and say fix it the right way! If they pitch a fit and refuse to fix it or pitch a fit about the check, too bad. They were hired to do a job that they did not do.

Why let them get the money for a job they did not do? Thats not right.

You cant legally cancel the check because they did provide a service. you would be in the wrong for doing that. The legitimate way would be to take the vehicle back to the shop and have them fix the car. Any reputable shop will back up their work. Whoever they received the transmission from should also warranty their parts. Check your paperwork.

If they refuse to fix it, which I doubt they will, then you will have grounds for a law suit which would be last resort. Usually you can ruffle their feathers with the BBB or attorney general.

You didn't mention the screwing part. That's why I clicked on your question in the first place. Did it happen in the back seat of the SUV after the transmission failed? Seriously, you need to find out if they are willing to fix it. There's a possibility that it wasn't something they did. "Gave out" is not a good description of the problem.

If the shop is reputable they will repair it under their warranty. Cancel the check and you will have a hard time getting warranty claims honored. Give them the benefit of the doubt sometimes even the best parts fail. If they don't honor their warranty then take everything they gave you in writing and then carry them to small claims court.

First of all, check your paperwork closely. Do they have a warranty. For this price, it should. If they have a warranty, bring it back and have them replace the transmission again.

If they don't have a warranty, call them anyways and see what they have to say.

If they won't fix it, take the repair shop to small claims court.

Bring as much documentation as you can and respectfully plead your case.
