I have been married for 7 years now and my husband is seperated from his still legally married wife since then. What is their status - married or divorced.

I have answered your previous question too. The status of your husband & his wife is still that of married couple unless their marriage is dissolved by the court of competent jurisdiction, i.e. in their case the Family Court which is equallent to the court of District Judge.

You can't get married until the divorce is trough. Depending on which country you live in it is possible the government will pay a part of the divorce, depending on your income. If you earn enough there is no other way then to pay a lawyer. I know it blows to have to spend money and time on someone you want to divorce anyway, but it is best for both of you if you get this done now. As long as your girlfriend is married, her husband will be entitled to half of the assets she owns, even the ones she gained while not living with him anymore. Unless other arrangements were made in a prenuptial agreement. In the worst case all the assets will go to her husband when she passes away before the divorce. So you are only losing out by not filing for divorce. Call a lawyer, explain the situation an see what they say. The court will investigate your husband's whereabouts to make him aware of the divorce. If they can't find him after a certain time, the marriage will be terminated and your girlfriend will keep her assets. As in this case there will be no discussion about who gets what the costs of a lawyer will be considerably less. Go for it, things only get more complicated and expensive if you leave them the way they are

Nothing is legally ended in a "marriage" without a judge ruling on it, granting a divorce and then placing those records in the court system. This is the way it is all over the United States. Their status is still married. I wish you well. Peace, Love and God Bless.

if u r a muslim and have not heard from him for 7 years then no. In u r religion u can marry another man; just take care of the divorce paper work before ur next marriage.

If u know he is alive and had contact with him; then yes in ur religion. even if u say u r separated from him.

Married until they are divorced. That's how it works - separation is just married but living separately, legally speaking.

Married. Divorce papers have to be filed and signed by both parties in order for it to be final. Sorry hun.

You can apply for divorce...
on grounds of the 7 yr seperation...there's a provision...
get urself a lawyer...

How did you manage to get a marriage licence if he did not have divorce papers? If he did not receive a divorce then your marriage to him is not legal

Whether you are separated from your husband for 7 months or 7 years or 70 years the marriage will not get dissolved authomatically all by itself. This might give you grounds for dissolution of marriage or divorce but the marriage will subsist until and unless it is dissolved by a Family Court or District Court.

You really need him to get this resolved because not only is he married to someone else, he may also be considered a bigamist and get into legal trouble for this!
