Are electric cut outs legal or illegal in the state of California?

The QTEC and any standard cutout are only legal for offroad use. If it closed on the street it is legal.

Knowing that California is an emission controlled state I would guess that cut outs are illegal. Not only that, that setup would be extremely loud.

I don't think that any cut outs are legal on the highways in any state.
