It's defamation, and yes it is.

First of all its defamation not deformation. Really not a very smart thing to do as the police could use this as evidence against your friend if they got their hands on it.
Its not defamation since he obviously was passed out -defamation is when you say something that is not true and it hurts the other person personally or professionally.

If he drank enough to pass out, how much character can he have?
You didn't say where you were from, but according to Wisconsin law, defamation is defined as anything that exposes the other to hatred, contempt, ridicule, degradation, or disgrace in society.
I really think the correct thing to do is delete the photo. You had your fun, give the poor guy a break (until next time he passes out)

I don't think it would be.. If you said anything about him like say you wrote he's gay or something like that that would be but a picture isn't really defamation of character and defamation is hard as hell to prove in a court..

Yes, and it's in poor taste. BTW this sounds like a photo circulating all over the world in an email.

Legally, I don't believe it is. But it doesn't make him look too sophisticated.
Update: I just looked at the Wiki article about Libel, and it looks like it could very well be. Theoretically, if he got a lawyer he could probably take you to court for this.

Probably not but remember what goes around comes around. Do you want an embarrassing picture of yourself posted for all to see.

that is in basic terms them attempting to experience significant, individually i think of that is stupid to place super quantities of pictures of your self on there, until eventually they are like inventive photographs. that is like they are asserting "look at me having relaxing!", incredibly no person else supplies a sh*t.........yet that's in basic terms my opinion.
