I'd have a good reason.
It would be the one year anniversary of my uncle's death, and he died at about five am, on his way to work.And I just want to sit with him and talk/cry.
and his death was well publicized in our town.
I'm sixteen, almost seventeen

He'd be happy with me being there, he enjoyed late night cemetery runs himself.
and I really don't care if its just his remains, its still his physical form, its still the face that I remember.
and both of my parents, have thus far consented to my plan.

Just depends...some cemeteries have fences and gates, some post hours, some post no trespassing. Even if you are not allowed to be there at 5am, I doubt you would be arrested. You would probably just be told to leave. Check for signs, locked gates after hours, etc. If there is none of that, go visit your uncle's grave. By the way, sorry for your loss.

Some towns have times of day when the cemetary is open...but I'm certain a simple call to the PD with your explaination will be all it takes to get around that.

Most cemetaries I know of are closed from dusk to dawn. You could be guilty of tresspassing. Unfortunately there are people who vandalize cemetaries and you might be mistaken for one.
I would contact them and tell them of the circumstances and see if they will accomodate a visit.

But please understand this. Only your uncle's remains are in the cemetery. Only the physical remains. I must agree that the loving thought is there as you would like to show your respect.
You can always call on your uncle's name and he will be there no matter where you are. :)

Depends on whether the cemetary is open at that hour. Some have hours of operation, and anything outside of that is trespassing.

A cemetary is usually private property. Check with the managers first to see if they have any restrictions.

Your uncle wouldn't want you there at that time. Don't get me wrong, he wants to be remembered, but not for dying. You need to remember the life lived, not the way/time he died. Visit him that day, for yourself to talk -- but make your life a tribute to him rather than make the day a tribute to his death.
Chances are that if the cemetery gates are open, it won't be a problem. If you would like to make a special request, it may be that they will open them for you or perhaps they won't - you should talk to the funeral home at the cemetery, or if it is rural, contact the local sheriff.

I'm pretty sure it is not illegal unless they claim trespassing, but you shouldn't be out there alone at that hour, especially when you're so young.
