To follow up to the question, and to your responses- while nothing has happened yet, the issue is this: When signing the application forms with personal information (social security number, etc)., The Gap says they DO NOT give out your information to any third party company, that your information is completely safe. In the letter they are sending out to these 800,000 people, they say they DID give out information to a third party, and then the laptops were stolen.

That is the problem. Are the victims going to wait 'til their identities will be misused improperly? That we have to wait 'til we suffer damages? But yes, it is true that it is hard to face this kind of situation, the fact that you don't know where or how to start. I was told by a lawyer that I couldn't sue them because there was no known damage to me or my personal information yet. But the fact that my personal information is out there and exposed gives me worries and a headache each and every single day. I wish GAP would handle the situation professionally. And yes, they may have not "given out" the informations of the 800,000 applicants, but they sure failed to do what they're supposed to. They should've made sure that our personal informations were encrypted!

Why, have you suffered any damages? There is no announced pending litigation. If you suffered damages, hire a lawyer.

They did not give it out, it was stolen. The laptops were owned by the Gap. That is not the same as "giving out" information.

If you sue now without actual damages, you cap the amount you can receive at what ever you win now.

Since they have a known list of victims, if a class action suit is started all persons in the class will be notified by mail.

Same happened to me. I'm mad at the fact NONE of our information was encrypted.. This should be against some laws that should make them encrypt private data like this. Is there a way to file suit against that?
