Hope someone can clarify this for me. My DH has just handed his notice in at work as he has a new job. His contract says notice is 'subject to the minimum requirements of section 86 of Employment rights act 1996.So as I see this he only needs to give 1 weeks notice? However, I said that is not fair to the company and he should give them 4 weeks, which he did. Now his boss says he should give 1 months notice, so I said to DH you did, but his boss expected him to put in 31 days notice? I've told DH his boss has misunderstood and the normal expectation for '1 month' is 4 weeks/28 days. Please tell me i'm right

he is fine to go he has done more than his notice and i'm sure the new job is waiting for him

He is only required to give 1 weeks notice:
"86(2) The notice required to be given by an employee who has been continuously employed for one month or more to terminate his contract of employment is not less than one week"

Minimum notice is in line with your opay cycle. So if you are paid calendar monthly, then ! calendar month is what you have to give as notice.

It is also worth looking at the contract of employment because there may be something else in there. I once had an employer who asked for 18 months notice in the employment contract. And yes, I was forced to serve the full 18 months when I resigned.,

The law states that you should(not have to) give notice concurrent with your pay cycle,,ie one months notice for being payed monthly,,however you can leave at any time without fear of reproach but your ex employer may have the right to withhold wages for early notice.....
I gave my last employer 1 days notice...no hang on it was actually 12 hours notice,,they could do nothing to me,,,,I was off sick the previous 10 weeks

The legal requirement is 1 weeks notice.

It all depends on how often he got paid, and what type of contract he is/was on.

If casual, 24 hrs.
If weekly paid, 7 days.
paid fortnightly 14 days.
etc.

If salaried (fixed amount over the year), its down to the contract, normally 1 month, which I would take as 28 days.

i was told one week notice for weekly paid 4 weeks for monthy paid EH
