Can one actually be awarded back child support if there is no court order for child support in effect? Those with legal knowledge please answer. Thank you in advance.

There has to be a court order in place. You can start now to get a court order for child support if the children are under 18 years of age.

Go to the child support enforcement internet site for your state and call them. Before you call make a list of all the things you want to ask. It might be better to make an appointment to meet with an agent face to face.

Yes. In Florida, my wife applied for Florida Kids insurance. They noted that there was no child support claimed for one of the children (different Father than the other two). This Father had never paid Child Support or even admitted being the Father of the child, age 16. Florida took the case to court, forced a DNA test and he was ordered to pay two years of child support. This covered age 16 to 18 since the previous time was not spent in Florida.

BEFORE I answer this I would need to know the state in which you are attempting to establish the support order and how old the child which is subject to the order is presently.

Also, any reason why you have not yet filed for support.

JUST TO CLARIFY:

There can be no arrears without a court order. What you are asking has to do with RETROACTIVE child support which is allowed in a number of states.

However, to give you a completely correct answer again, we would have to know the state in which the child resides.and for how long.

In PA, the answer is yes. I filed when my son was two and the court asked me if I'd like the arrears (back child support) added to the new court order.

in oregon and arizona the child support awarded goes back to the day of the childs or birth or when the parent left the household..althou sometimes they still go back to the day of birth even if the parent was in the household and with the child at the time

in general, there must be a court order, it will determine how much and from what date child support is ordered to be paid. good luck
